These Terms of Service govern your access to and use of PostSpice.com, including our website, applications, APIs, scheduling, publishing, analytics, and conversation-management features (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms.
1. Eligibility and accounts
You must be at least 18 years old and legally able to enter into these Terms. You must provide accurate account information, protect your login credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity performed through your account and for the users you authorize.
2. The Service
PostSpice helps users prepare, schedule, publish, manage, and analyze content across supported third-party platforms. Some features may let you retrieve, organize, read, or respond to messages when a connected platform officially permits that access. Feature availability varies by platform, account type, country, API approval, and the permissions you grant.
Scheduled delivery and analytics depend on third-party systems and are not guaranteed. You should review important or time-sensitive posts and messages directly on the relevant platform.
3. Connected platforms
You may connect accounts from social networks and other third-party services. You authorize PostSpice to access and act on those accounts only within the permissions you approve and the instructions you provide. Your use of each connected service remains subject to that provider’s terms, policies, and technical limits.
You must have authority to connect each account, publish its content, access its analytics, and read or respond to its communications. We may disable an integration when required by a provider, law, security concern, or API change.
4. Your content and instructions
You retain ownership of content and data you submit to the Service. You grant PostSpice a limited, non-exclusive, worldwide license to host, copy, format, transmit, publish, and otherwise process that content only as needed to operate, secure, support, and improve the Service or comply with law.
You are responsible for your content, publishing instructions, recipients, claims, permissions, intellectual-property rights, disclosures, and compliance with applicable advertising, privacy, consumer-protection, and communications laws.
5. Acceptable use
You may not use the Service to:
break any law or a connected platform’s rules;
send spam, harassment, threats, fraud, deceptive promotions, or unlawful automated messages;
publish content you do not have the right to use;
collect, expose, or misuse personal or confidential information;
bypass access controls, rate limits, platform review, or security protections;
introduce malware, disrupt the Service, scrape it without authorization, or attempt unauthorized access; or
use the Service to develop a competing product through systematic copying or reverse engineering, except where law expressly permits it.
6. Fees, subscriptions, and taxes
Paid plans, usage limits, billing periods, and prices are shown when you subscribe. You authorize our payment processor to charge the selected payment method for recurring fees and applicable taxes until cancellation. You may cancel future renewals through the available account or billing controls. Refunds, if any, are governed by the terms presented at purchase and applicable law.
7. Privacy and security
Our Privacy Policy explains how we handle personal data. Although we use reasonable safeguards, no online service is completely secure. You are responsible for choosing appropriate permissions, reviewing connected users, and maintaining your own copies of important content.
8. Third-party services
Connected platforms, payment processors, hosting providers, and other third parties operate independently from PostSpice. We do not control and are not responsible for their availability, policies, decisions, data, or changes. Third-party outages or API restrictions may interrupt features without notice.
9. Our intellectual property
The Service, excluding your content and third-party materials, is owned by or licensed to PostSpice and is protected by applicable intellectual-property laws. These Terms give you a limited, revocable, non-transferable right to use the Service for its intended purpose; they do not transfer ownership of the Service or our trademarks.
10. Suspension and termination
You may stop using the Service at any time. We may restrict or terminate access when you violate these Terms, create risk or harm, fail to pay applicable fees, or when required by law or a platform provider. Where practical, we will provide notice and a reasonable opportunity to export available data, unless prohibited or unsafe.
11. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not guarantee engagement, audience growth, delivery time, platform approval, analytics accuracy, or continued access to any integration.
12. Limitation of liability
To the maximum extent permitted by law, PostSpice will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunities. Our aggregate liability arising from the Service will not exceed the amount you paid to PostSpice during the six months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot legally be excluded.
13. Indemnity
To the extent permitted by law, you will defend and indemnify PostSpice against third-party claims, losses, and reasonable costs arising from your content, your connected accounts, your instructions, or your violation of these Terms, law, or another party’s rights.
14. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts with competent jurisdiction in India will have jurisdiction, subject to any mandatory consumer rights or dispute procedures that apply where you live.
15. Changes
We may update these Terms as the Service or law changes. We will post the revised version and update the effective date. For material changes, we will provide reasonable notice when practicable. Continued use after the effective date constitutes acceptance of the revised Terms.
16. Contact
Questions about these Terms may be submitted through the support option available in the Service.
